What is extended producer responsibility (EPR)?
Extended producer responsibility (EPR) obliges producers and retailers to ensure that their products are designed, used, and disposed of in an environmentally friendly manner throughout their entire life cycle. A producer within the meaning of EPR legislation is not only the body who actually produces the product, but also the party that offers it commercially or places it on the market for the first time in an EU country – i.e., dealers who sell items to customers in EU countries via Chrono24. The producer obligations take effect as soon as the products are offered for sale for the first time in the respective EU target country. EPR obligations apply in all EU countries, but may differ from country to country.
What are the obligations for dealers on Chrono24?
As an online marketplace, Chrono24 is legally obliged in EU countries to obtain information and evidence from dealers for certain product categories. In addition to the obligations to provide evidence to Chrono24, there may be other legal obligations that you must fulfill on your own – even if we do not specifically request or check them.
Relevant categories
- Packaging (PACK) – e.g., shipping and product packaging
- Batteries (BATT) – including built-in batteries in watches or accessories
- Electrical and electronic equipment (EEE) – e.g., quartz watches, smartwatches, or watch winders
Since packaging is always used when shipping goods, the regulations on extended producer responsibility for packaging affect all dealers on Chrono24 who offer their products in EU countries. Additional requirements apply if your products contain batteries or electronic components. For each of these categories (PACK, BATT, EEE), you must register separately in the respective country, participate in an approved recycling system, and submit the corresponding registration numbers (EPR numbers) and, if necessary, additional evidence to Chrono24. Retailers without a registered office in the respective EU country must generally appoint an authorized representative based there to fulfil their EPR obligations. An authorized representative can be a natural or legal person (e.g., via a paid service such as Interzero, Pronexa, take-e-way) who acts on your behalf and performs tasks such as registration, reporting, and communication with authorities for one or more EPR categories or EU destination countries.
What happens in the event of non-compliance?
As a dealer on Chrono24, you must ensure that you fulfill all legal obligations regarding extended producer responsibility (EPR). If you do not comply with these requirements, your listings will be considered non-compliant. In this case, Chrono24 may have to block or remove your listings for the target markets in which you do not meet the requirements in order to comply with the law. Depending on the country, fines or sales bans may also be imposed.
